The Supreme Court of India has allowed final-year law students to appear for the All-India Bar Examination (AIBE). The AIBE 19 exam is scheduled for November 24, 2024. A bench led by Chief Justice DY Chandrachud, along with Justices JB Pardiwala and Manoj Misra, passed the interim order while hearing a petition challenging a recent Bar Council of India (BCI) notification concerning eligibility for the AIBE exam.The notification had prohibited final-year (final semester) law students from appearing in the upcoming AIBE XIX.
During the hearing, the BCI stated that it needed time to frame rules regarding final-year law students. The bench responded that while the BCI could take time to formulate these rules, it should ensure that final-year students do not lose a year.
“We direct that the BCI shall permit the registration of all students who fall within the ambit of Paragraph 38 of the Bonnie Foi Decision. The above direction to operate in rem for the AIBE scheduled for November 24,” the bench stated, as reported by Live Law.
Accordingly, the bench issued an interim direction, clarifying that the order will apply to all final-year students, not just the petitioners.
The registration process for AIBE XIX is currently underway. Candidates can apply for the exam until October 25, 2024, and the last date to submit the application fee is October 28, 2024. Corrections to the application form can be made by October 30, 2024. The BCI will issue AIBE XIX admit cards on November 18, 2024, and the exam is scheduled for November 24, 2024.
